Objection by Third Parties, David Hammond and Hal Seibert to Proposed Stipulated Judgement Between Intervenors and U.S. Bank
The proposed Stipulated Judgment between Intervenors and U.S. Bank purports to snuff out a public easement that has been in existence since at least 1979 (Read the Objection, PDF ). Curiously, the parties “stipulating” to the Judgment are: (1) U.S. Bank – the owner of the parcel burdened by the public easement; and (2) the Intervenors – a small group of homeowners vocally opposed to and claiming to be aggrieved by the easement. Notably absent is any party representing the interests of the members of the public who actually use and support the easement – i.e., the parties benefitted by the easement.
